Terms and Conditions

1. Acceptance of Terms
By accessing or using the Monty's Handyman Services website (https://getmontys.com), submitting a lead form, requesting an estimate, or engaging our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our website or services.
2. Services
Monty's Handyman Services provides residential and commercial handyman, remodeling, or membership services, including but not limited to:
- Routine Home Maintenance
- Touch-Up Paint
- Dryer Vent Cleaning
- Appliance Installation
- Kitchen & Bathroom refresh
- Drywall Repair
- Door Installation
- Minor Repairs & Home Improvements
- Wood Rot Repair
- Fixture replacement
- Flooring
- Device Installation
- Gutter Cleaning
- Furniture Assembly
- Mobility Aids & Safety Aids Installation
Specific services, materials, pricing, and timelines are subject to the terms of individual written estimates or contracts provided to you.
3. Estimates and Pricing
Estimates provided by Monty's Handyman Services are based on information available at the time of assessment, including visual inspection, satellite imagery, and details you provide. Estimates are valid for 30 days from the date issued unless otherwise stated.
Actual project costs may differ from estimates due to unforeseen site conditions, including but not limited to: structural issues discovered during installation, code compliance requirements, material availability, grade or drainage conditions, HOA requirements, or insurance adjuster revisions discovered after the estimate is provided.
Monty's Handyman Services reserves the right to adjust pricing if material costs change significantly between the date of estimate and the date of installation.
4. Property and Site Conditions
By engaging our services, you represent and warrant that:
- You are the property owner or have authorization from the property owner to authorize handyman, remodeling, or membership service work
- You have obtained or will obtain any required HOA approvals before installation
- You will disclose known structural issues, prior damage, or conditions that may affect the scope of work
- You will provide reasonable access to the work area on the scheduled installation date(s)
Monty's Handyman Services is not responsible for damage to concealed or undisclosed conditions discovered during the course of work. We recommend disclosing all known property conditions prior to project commencement.
5. Payment Terms
Payment terms will be specified in your individual estimate or contract. Unless otherwise agreed in writing:
- A deposit may be required prior to scheduling installation
- Final payment is due upon completion of installation
- Accepted payment methods will be communicated at the time of booking
- Late payments may be subject to a fee of 1.5% per month or the maximum rate permitted by law, whichever is less
6. Scheduling and Cancellation
Installation dates are scheduled based on material availability, crew availability, and weather conditions. Monty's Handyman Services will make reasonable efforts to meet scheduled dates but is not liable for delays caused by weather, material supply chain disruptions, permit delays, or other circumstances beyond our control.
If you need to cancel or reschedule, please provide at least 48 hours' notice. Deposits may be non-refundable if cancellation occurs after materials have been ordered.
7. Warranty
Monty's Handyman Services provides a workmanship warranty as specified in your individual contract or estimate. This warranty covers defects in installation and labor. It does not cover:
- Normal wear and tear, weathering, or natural aging of materials
- Damage caused by storms, floods, wind, hail, or other acts of nature
- Damage caused by third parties, animals, vehicles, or improper use
- Changes to grade, drainage, or landscaping that affect the work after installation
- Pre-existing structural conditions not disclosed prior to project commencement
Material warranties are provided by the respective manufacturers and are separate from our workmanship warranty.
8. Limitation of Liability
To the maximum extent permitted by law, Monty's Handyman Services' total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. Monty's Handyman Services shall not be liable for any indirect, incidental, consequential, or punitive damages.
9. SMS/Text Message Terms
By providing your mobile phone number on any Monty's Handyman Services form, you consent to receive text messages (SMS/MMS) from Monty's Handyman Services. These messages may include:
- Responses to your inquiry or estimate request
- Appointment confirmations and reminders
- Project updates and scheduling notifications
- Follow-up communications related to your handyman, remodeling, or membership service.
Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message you receive from us. For help, reply HELP or contact us at the information provided in Section 17.
Consent to receive text messages is not a condition of purchasing any goods or services from Monty's Handyman Services. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Carriers are not liable for delayed or undelivered messages.
10. Intellectual Property
All content on the Monty's Handyman Services website, including text, images, graphics, logos, and design, is the property of Monty's Handyman Services or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
11. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe upon or restrict the rights of others. You may not:
- Use the website in any way that could damage, disable, or impair its functionality
- Attempt to gain unauthorized access to any part of the website or its systems
- Use the website to transmit any harmful, offensive, or illegal content

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk.
13. Indemnification
You agree to indemnify and hold harmless Monty's Handyman Services, its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of our website or services, your breach of these Terms, or your violation of any law or the rights of a third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any dispute arising from or relating to these Terms or our services shall be resolved in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by the "Effective Date" at the top of this page. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
